Hyperion Skies Studios

This agreement is governed by the laws of Ohio and the United States. Any disputes will be brought in a court of appropriate jurisdiction in Cuyahoga County, Ohio.

Attribution

All licensed content is owned by Hyperion Skies Studios; all rights not expressly granted in this agreement are reserved by Hyperion Skies Studios. When using the licensed content, you must include credit to “Alexander Hyperion Skies” or “Hyperion Skies Studios” for the artwork. You may use the name of Hyperion Skies Studios or Alexander Hyperion Skies as necessary to give attribution, but you may not otherwise use their names, logos, or trademarks without prior written approval.

Applicable Content

This license applies to purchased stock art products listed at hyperionskies.itch.io or by the publisher Hyperion Skies Studios on DriveThruRPG.com. The license comes into effect upon purchase and is perpetual, even if the purchased product listing is taken down for any reason after the purchase is made. 

Restrictions on Use

The licensed stock art is available only for use within other publications, for example: adventures, modules, world building and character supplements, etc. 

In addition:

No Unlawful Use. You may not use content in a defamatory or other unlawful manner, to promote violence or hatred (including, but not limited to, bigotry such as transphobia, homophobia, sexism, or racism), or in violation of any applicable regulations (including for sports content, any restrictions or credentials issued by a sports league or governing body) or industry codes. 

No License Transfer. With the exception of rights otherwise granted, you are not authorized to sub-license, sell, or lease the content, nor may you temporarily or permanently transfer your rights under this agreement to a third party. This includes displaying the content in any format for download on a website, offering the content for sale, or otherwise for distribution and/or sale to third parties. This refers to the licensed content itself, not publications using the content, meaning that you may not sublicense, resell, or lease the licensed stock art by itself, and that only the purchaser of the stock art may incorporate it into their projects and publications. The only exception is if you obtain prior written approval from Hyperion Skies Studios. 

No Alteration. Content may be cropped, desaturated for grayscale or black and white publications, or otherwise edited for technical quality, but you may not otherwise alter the content.

No Standalone File Use. You may not use content in any way that allows others to download, extract or redistribute content as a standalone file (meaning just the content file itself, separate from the project or end use).

No 'On-Demand' Products. You may not use content in connection with "on-demand" products (e.g., products in which a licensed image is selected by a third party for customization of such product on a made-to-order basis), including, without limitation, postcards, mugs, t-shirts, calendars, posters, screensavers or wallpapers on mobile telephones, or similar items (this includes the sale of products through custom designed websites, as well as sites such as zazzle.com and cafepress.com).

No Electronic Templates. You may not use content in electronic or digital templates intended for resale or other distribution (for example, website templates, business card templates, electronic greeting card templates, and brochure design templates).

No Use in Trademark or Logo. You may not use content (in whole or in part) as the distinctive or distinguishing feature of a trademark, design mark, trade name, business name, service mark, or logo. Additionally, you shall not be entitled to register (in any jurisdiction) such content (in whole or in part) as a trademark or rely on any such registrations, prior use, and/or accrued goodwill to prevent any third party use of the content or any similar content (including by Hyperion Skies Studios, Alexander Hyperion Skies, or our customers).

No Machine Learning or AI. You may not use content (including any caption information, keywords or other metadata associated with content) for any machine learning and/or artificial intelligence purposes. 

No NFT Use. You may not use any content in connection with an immutable digital asset intended for sale or other distribution (such as a non-fungible token).

No False Representation of Authorship. You may not falsely represent that you are the original creator of a work that is made up largely of licensed content. For instance, you cannot create artwork based solely on licensed content and claim that you are the author.

Note that under no circumstances will content sold under this license be converted to exclusive-use, this type of licensing is only available for custom work that has not already been licensed.
